Welcome to HandmadeWithHeritage. These Terms of Service (“Terms”) govern your use of handmadewithheritage.com (the “Site”) and any purchases made through the Site.

Throughout these Terms, “HandmadeWithHeritage,” “we,” “us,” and “our” refer to HandmadeWithHeritage. “You” and “your” refer to any visitor, customer, or user of the Site.

By visiting the Site or purchasing from us, you agree to these Terms, our Privacy Policy, Shipping Policy, and Return and Replacement Policy. If you do not agree, please do not use the Site.

1. Eligibility and Online Store Use

You must be at least the age of majority in your state or place of residence to use the Site or make a purchase. You may not use our products or services for any unlawful or unauthorized purpose.

You are responsible for ensuring that the information you provide during checkout is complete, current, and accurate.

2. Handmade Products and Natural Variations

Many of our products are handmade, artisan-created, or produced using traditional techniques. Minor variations in color, pattern placement, texture, stitching, beadwork, metal finish, measurements, and other details are natural characteristics of handmade products.

Colors may also appear differently depending on your screen, device, lighting, and display settings. These natural or screen-related variations are not considered defects.

3. Product Information and Availability

We make reasonable efforts to display product descriptions, images, prices, dimensions, and availability accurately. However, occasional errors may occur.

Products and quantities are subject to availability. We may limit quantities, discontinue products, correct errors, or update product information at any time without prior notice.

We reserve the right to cancel or refuse an order if a product is unavailable, incorrectly priced, affected by a listing error, or suspected to be associated with fraud or unauthorized activity.

4. Prices, Payments, and Taxes

All prices are displayed in the currency shown at checkout. Prices may change without notice, but changes will not affect orders that have already been accepted unless there was an obvious pricing or listing error.

Applicable taxes, shipping charges, and other fees will be displayed during checkout when required.

Payment must be authorized before an order can be processed. Payments are handled through Shopify and its approved payment providers. We do not directly store complete payment-card information.

5. Orders and Order Acceptance

Submitting an order does not guarantee acceptance. An order is accepted after payment is authorized and we begin processing or send confirmation that the order has been accepted.

We may contact you if additional information is needed to process your order.

If you need to request an order change or cancellation, contact us immediately. We cannot guarantee that changes or cancellations can be made after an order has entered processing or been shipped.

6. Shipping and Delivery

Orders are processed and shipped according to our published Shipping Policy. Delivery estimates are provided in good faith but are not guaranteed.

Carrier delays, severe weather, incorrect addresses, customs processing, and other circumstances outside our reasonable control may affect delivery times.

Customers are responsible for providing a complete and accurate shipping address. Additional shipping expenses resulting from an incorrect or incomplete address may be the customer’s responsibility, except where prohibited by law.

7. Returns, Replacements, and Final-Sale Terms

Due to the handmade and carefully selected nature of our products, all sales are final, except where otherwise required by applicable law.

We do not accept returns or exchanges for changes of mind, color or size preferences, natural handmade variations, or other personal reasons.

If an item arrives damaged, defective, or incorrect, you must contact us within 48 hours of delivery and provide:

Your order number
Clear photographs of the item
A video clearly showing the damage or defect
Photographs of the original packaging and shipping label

After the issue has been reviewed and verified, a replacement will be offered. The item must remain unused and in its original condition and packaging.

For verified damaged, defective, or incorrect products, HandmadeWithHeritage will pay approved return-shipping costs and provide return instructions. Unauthorized returns will not be accepted.

8. Promotions and Discount Codes

Promotions and discount codes may be subject to separate eligibility requirements, expiration dates, exclusions, or purchase minimums.

Unless expressly stated otherwise, discounts cannot be combined, exchanged for cash, or applied retroactively to completed orders. We may modify or end a promotion where permitted by law.

9. Intellectual Property

All Site content—including our business name, branding, photographs, graphics, product descriptions, designs, text, arrangement, and other original materials—is owned by or licensed to HandmadeWithHeritage and is protected by applicable intellectual-property laws.

You may access the Site for personal, noncommercial shopping purposes. You may not copy, reproduce, republish, modify, distribute, sell, or commercially exploit Site content without prior written permission.

10. Reviews and Customer Content

If you submit a review, photograph, comment, testimonial, or other content, you confirm that you have the right to share it and that it does not violate another person’s rights.

You grant HandmadeWithHeritage a nonexclusive, worldwide, royalty-free license to use, reproduce, display, and share submitted content in connection with our store and marketing, unless prohibited by law.

We may remove content that is unlawful, abusive, misleading, discriminatory, infringing, or otherwise inappropriate. We are not obligated to publish every submission.

11. Prohibited Conduct

You may not:

Use the Site for an unlawful or fraudulent purpose
Submit false, misleading, or inaccurate information
Interfere with the Site’s security or operation
Introduce malicious code, viruses, or harmful technology
Scrape, copy, or collect Site content or customer information without authorization
Attempt to gain unauthorized access to the Site or related systems
Violate intellectual-property, privacy, publicity, or other legal rights
Use the Site to harass, abuse, threaten, or discriminate against others
Place fraudulent orders or abuse promotions, payment disputes, or return processes

We may restrict or terminate access to the Site for violations of these Terms.

12. Third-Party Services and Links

Our Site is hosted by Shopify and may use third-party providers for payment processing, shipping, analytics, marketing, and other services.

The Site may contain links to third-party websites. We do not control and are not responsible for third-party content, policies, security, products, or services. Your use of third-party services may be subject to their own terms and privacy policies.

13. Privacy

Your submission and use of personal information are governed by our Privacy Policy.

14. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis.

We do not guarantee that the Site will always be uninterrupted, secure, error-free, or free of harmful components. Nothing in these Terms excludes warranties, rights, or remedies that cannot lawfully be excluded.

15. Limitation of Liability

To the fullest extent permitted by applicable law, HandmadeWithHeritage and its owners, employees, affiliates, service providers, and representatives will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the Site or purchase of products.

Where liability cannot be excluded, our liability will be limited to the amount you paid for the product or order giving rise to the claim, except where a different limitation is required by law.

These limitations do not apply to liability that cannot legally be limited or excluded.

16. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless HandmadeWithHeritage and its owners, employees, affiliates, and service providers from claims, damages, expenses, or liabilities arising from your unlawful use of the Site, violation of these Terms, or infringement of another person’s rights.

17. Governing Law

These Terms are governed by the laws of the State of Illinois and applicable United States federal law, without regard to conflict-of-law principles.

Nothing in this section limits any mandatory consumer rights or protections that apply in your place of residence.

18. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.

19. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.

20. Changes to These Terms

We may update these Terms periodically to reflect changes to our practices, services, or legal obligations. The revised Terms will be posted on this page with an updated effective date.

Your continued use of the Site after revised Terms are posted constitutes acceptance of the updated Terms to the extent permitted by law.

21. Agents

This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.

No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 14.4 below. In addition, no Agent may access, use, or interact with Services if we have requested that the Agent refrain from accessing, using, or interacting with any service.

We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services.

Agents must: (a) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (b) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (i) mimicking human behavior and interaction patterns, or (ii) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans, (c) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer, (d) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.
